These Terms of Use (“Terms”) govern your access to and use of GlucoScan, operated by Makhado Labs (the “Service”). By downloading, accessing, or using GlucoScan, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
GlucoScan is a consumer mobile application that estimates nutrition and potential blood sugar impact from meal photos. Contact: support@glucoscan.app.
2. Eligibility
You must be at least 13 years old (or the minimum digital consent age in your country) to use GlucoScan. If you use the Service on behalf of someone else, you represent that you have authority to accept these Terms for them.
3. The Service
GlucoScan may allow you to:
- Capture or select meal photos for analysis.
- View estimated nutrition values and a blood sugar impact score.
- Receive ingredient detection, summaries, and suggested swaps.
- Store scan history locally on your device.
Features, availability, and free daily scan limits may change over time. We may update, suspend, or discontinue parts of the Service without prior notice.
4. Not medical advice
GlucoScan is not a medical device and does not provide medical advice, diagnosis, or treatment. Analysis results are estimates based on image recognition and AI models. They may be inaccurate or incomplete. Always consult a qualified healthcare professional for decisions about diabetes management, nutrition, medication, or other health matters. Never disregard professional medical advice because of something you see in the app.
5. Your responsibilities
- Use the Service only for lawful, personal, non-commercial purposes unless we agree otherwise.
- Provide accurate information when contacting support.
- Do not upload unlawful, harmful, or infringing content.
- Do not attempt to reverse engineer, disrupt, or abuse the Service or its APIs.
- Do not use GlucoScan as a substitute for clinical tools or professional care.
6. Accounts and device storage
Core features may work without creating an account. Preferences and history stored on your device may be lost if you uninstall the app, clear app data, or change devices. You are responsible for keeping your device secure.
7. Intellectual property
GlucoScan, including its design, branding, software, and content we provide, is owned by Makhado Labs or its licensors. You receive a limited, non-exclusive, non-transferable license to use the app as permitted by these Terms and applicable app store rules. You retain rights to photos you submit, and you grant us a limited license to process them to provide analysis results.
8. Third-party services
The Service may rely on third-party AI, cloud, and platform providers (including Apple App Store and Google Play). Your use of those platforms is also subject to their terms. We are not responsible for third-party services we do not control.
9. Purchases and subscriptions
If paid features, subscriptions, or in-app purchases become available, pricing, billing, renewals, and cancellations will be handled through the applicable app store unless we state otherwise. Taxes may apply. Refunds are subject to the store’s policies and applicable law.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE ERROR-FREE OR THAT THE SERVICE WILL BE UNINTERRUPTED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKHADO LABS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
12. Indemnity
You agree to indemnify and hold harmless Makhado Labs from claims arising out of your misuse of the Service, your content, or your violation of these Terms or applicable law.
13. Termination
You may stop using GlucoScan at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that should survive termination will survive, including ownership, disclaimers, and limitations of liability.
14. Changes to these Terms
We may update these Terms periodically. The “Last updated” date will change when we do. Continued use after changes means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws applicable in the jurisdiction where Makhado Labs operates, without regard to conflict-of-law principles, except where mandatory local consumer laws give you additional rights.
